More specifically, the administrative settlement includes an agreement that the Town will pay EPA $50,000.00 and provide in-kind services with an estimated value of $2.75 million to reimburse EPA for its past response costs (the Town does not have an inability to pay claim for this settlement) and that based on submitted financial documentation and EPA?s determination that the City has no ability to pay the claim, the City will pay $1,000.00 as consideration for its settlement. EPA did not receive any written comments on the cost compromise included in the proposed settlement during the 30-day period.
