Case summary

On August 10, 2026 the United States Magistrate Court approved an ex parte warrant granting EPA access for two years to continue to perform and complete a Remedial Investigation and Feasibility Study ( RI/FS ) and to commence Remedial Design activities at the Microfab, Inc. (Former) Superfund Site located in Amesbury, MA under Section 104(e) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980, as amended ( CERCLA ), 42 U.S.C. Section 9604(e). This warrant follows three previous warrants approved by the Court: on August 15, 2018 for three years of access to the Site followed by another warrant approved on August 10, 2021 for two years of access to the Site, followed by another warrant approved on August 9, 2023 for three years of access. The most recent warrant would have expired on August 9, 2026. The abandoned Site is in poor condition. EPA was unable to secure voluntary access to the Site because the former corporate owner of the Site no longer exists, and no other company or former corporate officer believed they had authority to grant access to EPA.
