Case summary

The City of Chicopee, Massachusetts owns and operates a wastewater treatment facility (WWTF). The City was issued a new NPDES permit for the WWTF on November 22, 2021, which authorizes the WWTF to discharge pollutants to the Connecticut River. The Permit contains effluent limits for Aluminum, Biological Oxygen Demand ( BOD ) and Total Suspended Solids ( TSS ), which the WWTF cannot meet as currently configured. The AO, issued on August 29, 2025, contains interim limits for Aluminum, BOD and TSS as well as a compliance schedule for the WWTF to make the necessary upgrades to come into compliance with the NPDES permit. The City is required to initiate construction of the necessary plant upgrades by July 1, 2026 and complete work by July 1, 2028. EPA Region 1 staff have coordinated with the Massachusetts Department of Environmental Protection during the development of this Order.
