Case summary
On August 27, 2025, the Region issued an Administrative Order for Compliance ( Order ) to Tracy Atwater, Geldbaum, LLC, and Neverbuilt, LLC (collectively Respondents ). The Order addressed Respondents' non-compliance with the requirements of the federal Construction General Permit ( CGP ). Respondents are operators of a residential development located in Southbridge, Massachusetts. Under the Order, Respondents are required to come into compliance with CGP requirements, stabilize and mitigate pollution from inactive areas of the site, develop a Stormwater Pollution Prevention Plan, and conduct CGP required stormwater inspections. The NPDES CGP program has not been delegated to Massachusetts, but MassDEP supports issuance of this Order.
