Case summary

On July 10, 2025, EPA filed a Consent Agreement and Final Order with D & F Afonso Builders, Inc. ( D & F ) for discharges of stormwater without authorization under the National Pollutant Discharge Elimination System (NPDES) Construction General Permit (CGP) for Stormwater Discharges from Construction Activities. EPA conducted an inspection of D & F's residential development in Milford, Massachusetts on December 10, 2024. In addition to noting that the developer did not have CGP coverage, EPA identified several deficiencies at the site, including failed silt fences on the perimeter, and stockpiles and other slopes that were not stabilized. D & F will pay a penalty of $32,550. After EPA's inspection, D & F obtained CGP coverage. The Region coordinated with the Massachusetts Department of Environmental Protection on this case.
