Case summary
On August 13, 2025, EPA Region 1 entered into an administrative order on consent with Guida-Seibert Dairy Company to bring its facility into compliance with the chemical accident prevention provisions of Section 112(r) of the Clean Air Act ( CAA ), 42 U.S.C. Section 7412(r), and the Risk Management Plan ( RMP ) regulations promulgated thereunder at 40 C.F.R. Part 68. EPA alleged violations related to the design and operation of the ammonia cooling system at the dairy processing facility in New Britain, Connecticut. Complying with RMP regulations helps companies prevent accidental releases of extremely hazardous substances. Also, the RMP requirements help companies and emergency responders prepare for and respond to chemical emergencies
