Lopes' alleged violations of the New Source Performance Standards ( NSPS ), specifically the NSPS for Nonmetallic Mineral Processing Plants, 40 C.F.R. S 60.670 - 60.676 ( Subpart OOO ). Under the Order, G. Lopes has six months to conduct an emissions test and come into compliance with Subpart OOO. MassDEP does not have authorization for these standards.
