Case summary

On January 22, 2025, EPA filed a Clean Air Act (CAA) Administrative Order on Consent (Order) with Markings, Inc. (Markings) of Pembroke, Massachusetts. Markings owns and operates a fleet of trucks that perform pavement marking and painting services for cities, towns, states, and private contractors throughout New England. The Order addresses Markings' alleged violations of federally enforceable anti-idling requirements in the Massachusetts state implementation plan, which prohibit motor vehicles from idling for more than five minutes. Under the Order, Markings has agreed to implement enhanced anti-idling protocol where it currently operates, including implementing anti-idling idling monitoring, training, and signage. Diesel exhaust exposure can lead to serious health conditions like respiratory illnesses and asthma and can exacerbate existing heart and lung disease, particularly in the elderly and children. EPA's investigation into Markings' operations was initiated in response to a public complaint. EPA provided the Notice of Violation, issued on August 14, 2024, to Massachusetts and plans to inform the Commonwealth about this Order.
