Case summary

On October 4, 2023, EPA settled an administrative penalty action against Great Lakes Dredge & Dock Co., LLC, for alleged violations of the Marine Protection, Research and Sanctuaries Act (commonly known as the Ocean Dumping Act') that occurred during the disposal of material dredged from a Portsmouth Harbor Federal Navigation Project. Under the agreement, Great Lakes agrees to pay a $92,500 penalty and undertake a mitigation project designed to prevent future mis-dumps (estimated to cost in excess of $100,000). Specifically, the company will retrofit all control boxes to include a secondary dump initiation button so that two steps are required to start a dumping sequence and will install geofence-type control hardware/software on its 14 scows to help prevent disposal outside of pre-set GPS coordinates. Great Lakes must also provide training on use of both these technologies.
