Case summary

On May 10, 2024, EPA settled an administrative penalty action against Electronic Products Industries LLC (Respondent) alleging violations of Section 112(r)(1) of the Clean Air Act (CAA), known as the General Duty Clause, and Section 313 of the Emergency Planning and Community Right to Know Act (EPCRA). These violations arose from Respondent's storage and use of anhydrous ammonia at its glass-to-metal seal and high-temperature co-fired ceramic manufacturing facility (Facility) in Newburyport, Massachusetts. Respondent violated EPCRA Section 313 by failing to timely submit and certify Toxics Release Inventory reporting forms for anhydrous ammonia used at the Facility in calendar years 2019, 2020, and 2021. The consent agreement and final order requires Respondent to pay a civil penalty of $117,647. CAA 112r and EPCRA are direct implementation programs, but EPA has notified the Commonwealth of Massachusetts of the settlement.
