Case summary

On March 27, 2024, the Regional Judicial Officer approved an expedited settlement agreement with Supreme Forest Products, Inc. of Harwinton, Connecticut d/b/a E.R. Hinman & Sons, Inc. (E.R. Hinman) located in Burlington, Connecticut resolving alleged violations of Section 301 of the Clean Water Act. An EPA off-site compliance evaluation of E.R. Hinman's facility in Burlington and subsequent information request revealed that the facility was discharging stormwater from point sources at the site. These stormwater discharges were neither authorized by an individual National Pollutant Discharge Elimination System (NPDES) permit nor the NPDES Multi-Sector General Permit for Stormwater Discharges Associated with Industrial Activity (MSGP). The company promptly worked toward obtaining MSGP coverage. The settlement requires that the company pay a $4,000 penalty. The Region worked in coordination with the Connecticut Department of Energy & Environmental Protection on this case.
