Case summary

On February 6, 2024, EPA issued a Clean Water Act Administrative Compliance Order (Orders to the City of Chicopee, Massachusetts for violations of the Massachusetts Municipal Separate Storm Sewer System (MS4) Permit requirement to enact a post-construction stormwater management ordinance, by-law, or other regulatory mechanism (2017 MS4 Permit). The Order requires the municipality to enact a post-construction stormwater management ordinance or other regulatory mechanism by June 30, 2024; notify EPA that such an ordinance or regulatory mechanism has become effective within seven days of its effective date; and provide the Agency with a copy of the regulatory mechanism.
