On January 16, 2024, the Regional Judicial Officer approved an expedited settlement agreement with Lifoam Industries, LLC of North Andover, Massachusetts resolving alleged violations of Section 301 of the Clean Water Act. EPA found through a desktop audit of Lifoam's facility that the facility had failed to reapply for permit coverage under either an individual National Pollutant Discharge Elimination System (NPDES) permit or the 2021 reissuance of the NPDES Multi-Sector General Permit for Stormwater Discharges Associated with Industrial Activity (MSGP) and had been discharging stormwater associated with industrial activity without authorization under either an individual permit or the MSGP since May 31, 2021.
