Case summary

On August 10, 2023, EPA issued A Notice of Warning (NOW) to Nordson EFD LLC's East Providence, RI facility based on their failure to file timely complete annual production reports. The reports, required under Section 7(c) of the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA), are due by March 1st each year and cover the production, sales and distribution of pesticides and devices for the preceding calendar year. The reports are EPA's principal source of information on pesticides and devices produced in the U.S. and abroad. The annual production reports allow EPA to have reliable and accurate information about the pesticides imported, sold, or delivered in the U.S., which helps maintain the integrity of the national pesticides program. FIFRA annual reporting is a federal requirement not enforceable by the states under primacy or delegation. Rhode Island will be notified of the NOW issued to the establishments in their state.
