Case summary

On November 21, 2022, EPA and Twin Rivers Paper Company LLC (Twin Rivers) settled an administrative penalty case for alleged violations of the Emergency Planning and Community Right- to-Know Act (EPCRA) and EPCRA regulations that occurred at Twin Rivers' paper mill facility in Madawaska, Maine. EPA alleged that Twin Rivers failed to timely file EPCRA Section 313 Toxic Release Inventory (TRI) reports for nitrate compounds used at the facility during calendar years 2017, 2018, and 2019. Twin Rivers filed its missing TRI reports in July 2021 after being notified of this requirement. EPA and Twin Rivers settled the case with a Consent Agreement and Final Order (CAFO) that both initiated and concluded the action. Under the CAFO, Twin Rivers agreed to pay a settlement penalty of $67,721. EPCRA's TRI reporting program is a non-delegated federal program enforced only by EPA with no state involvement. Enforcement of EPCRA's TRI reporting requirements ensures that communities are not deprived of their right to know about chemicals released, used, or stored within their vicinity that may affect public health or the environment.
