Case summary

On July 18, 2023, the Regional Judicial Officer approved an expedited settlement agreement with Scrap Metals, Inc. ( Scrap Metals ) of Nashua, New Hampshire resolving alleged violations of Section 301 of the Clean Water Act. On November 2, 2022, EPA Region 1 (the Region ) conducted an inspection of the facility and found that Scrap Metals was discharging stormwater from point sources at the site. These discharges were neither authorized by an individual National Pollutant Discharge Elimination System ( NPDES ) permit nor by the NPDES Multi-Sector General Permit for Stormwater Discharges Associated with Industrial Activity ( MSGP ). The company promptly worked towards obtaining MSGP coverage. The settlement requires that the company pay a $7,500 penalty. The Region worked in coordination with the Massachusetts Department of Environmental Protection on this case.
