EPA v. EPPING WASTEWATER TREATMENT FACILITY

Case summary

On May 11, 2023, the Region issued an administrative order (AO) to the Town of Epping, New Hampshire to cease bypasses at its wastewater treatment plant. The plant discharges upstream of several communities that draw from the Lamprey River for their drinking water supply. The AO requires the Town to complete all work on a Short-Term Corrective Action Plan (CAP) by December 31, 2023, and to submit to EPA and NHDES a Long-Term CAP by June 30, 2024. Additionally, the AO requires the Town to develop a Fats, Oil and Grease program and to conduct a staffing evaluation at its Facility. Partially treated wastewater discharges from the plant impact downstream residents facing many environmental justice issues. The Region worked in close coordination with the New Hampshire Department of Environmental Services in this matter.
