Case summary

On May 11, 2023, EPA filed a Consent Agreement and Final Order in which Minichiello Bros., Inc. will pay a penalty of $54,420 for discharging stormwater without having coverage under the federal Multi-Sector General Permit for Stormwater Discharges Associated with Industrial Activity (MSGP) or any other NPDES permit. EPA inspected Minichiello Bros., Inc., owner and operator of a scrap metal recycling facility in Everett, Massachusetts to determine compliance with the Clean Water Act. At the time of the inspection, the facility failed to have any permit authorizing its stormwater discharges. After the inspection, the company prepared a Stormwater Pollution Prevention Plan and submitted a Notice of Intent to obtain MSGP coverage. The facility is located in an area where residents are impacted by Environmental Justice issues. EPA coordinated with the Massachusetts Department of Environmental Protection in this matter.
