Case summary

On April 18, 2023, EPA issued a Clean Water Act Administrative Compliance Order to the Town of Rutland, Massachusetts citing its failure to screen all relevant outfalls/interconnections for the presence of dry-weather flow by July 1, 2021, as required by the 2016 Municipal Separate Storm Sewer System (MS4) permit. The Order requires the Town to submit electronic copies of all existing dry-weather screening information for any of its MS4 outfalls/interconnections, submit a schedule to complete all dry-weather screening of its MS4 outfalls/interconnections not yet screened, and implement the schedule subject to any modifications from EPA within 30 days of receipt of the Order. The Region coordinated with the Massachusetts Department of Environmental Protection on this matter.
