Case summary

The Agreement stems from an incident on December 1, 2022, when 132 gallons of diesel oil was spilled from an oil tank vent located on the roof of the company building. The tank was in the process of being filled. Some of the oil then flowed into a roof top drain connected to the municipal storm sewer system which flows into the Merrimack River, a drinking water supply source for several downstream communities. The company responded promptly to the spill and reported the incident to the New Hampshire Department of Environmental Services. The spill occurred in a community that faces Environmental Justice issues. The company agreed to a $4,385 penalty.
