On March 28, 2023, EPA issued a Clean Water Act (CWA) Administrative Compliance Order (Order) to the Town of Berkley, Massachusetts (Town) for violations of its 2016 Municipal Separate Stormwater Sewer System (MS4) permit. The Town failed to screen all required stormwater outfalls/interconnections for the presence of dry weather flow and failed to submit its Year 4 MS4 annual report that was due by September 28, 2022. The Order requires the Town to provide EPA with electronic copies of all existing dry-weather screening information for its MS4 outfalls/interconnections and submit its Year 4 MS4 annual report within 30 days of the effective date of the Order. EPA coordinated with the Massachusetts Department of Environmental Protection on this matter.
