08/13/2026: Consent Decree lodged with the court. More details to come. On March 3, 2023, EPA Region 1 referred to the U.S. Department of Justice a CWA matter, concerning Old Dutch Mustard Co., Inc. d/b/a Pilgrim Foods. Pilgrim Foods owns and operates a vinegar and mustard production company. The referral concerns Pilgrim Foods' alleged unpermitted discharges from its Facility, with a low pH, to an unnamed brook and then into the Souhegan River, which is a tributary of the Merrimack River in southern New Hampshire. Pilgrim Foods' low pH discharges are not authorized by a National Pollutant Discharge Elimination System (NPDES) permit. These discharges are also not authorized by the Multi-Sector General Permit for Stormwater Discharges Associated with Industrial Activity (MSGP), issued by EPA on January 15, 2021, and are allegedly in violation of the requirement in Part 2.2.1 of the 2021 MSGP that all discharges must be controlled as necessary to meet applicable water quality standards.
