Case summary
On October 5, 2022, EPA issued a Clean Water Act administrative order (Order) to the Town of Newport, New Hampshire for violations of the phosphorus and ammonia nitrogen limits contained in its National Pollutant Discharge Elimination System (NPDES) Permit. The Order sets forth the schedule for the Town to achieve compliance with the effluent limits at its wastewater treatment plant. By June 30, 2026, the Town is required to complete all construction phases of the Final Design for its wastewater treatment plant upgrade. By September 30, 2026, the Town is required to meet all permit limits. The estimated cost of the installation of the nutrient controls is $24 million. Region 1 worked in close coordination with the New Hampshire Department of Environmental Services in this matter.
