Case summary

On September 27, 2023, EPA entered into a Consent Agreement and Final Order (CAFO) with All-Star Transportation LLC (All-Star), a school bus fleet operator in Connecticut, resolving alleged violations of provisions of the federally approved Connecticut state implementation plan (SIP) in its operation of school buses. The requirements at Section 22a-174-18(b)(3) of the Regulations of Connecticut State Agencies prohibit the excessive idling of motor vehicles and are approved and enforceable by EPA. The administrative penalty case alleged that All-Star idled school buses excessively for nearly 800 minutes on four occasions at its New Milford and Brookfield facilities. Exposure to diesel exhaust can lead to serious health conditions like asthma and respiratory illnesses and can worsen existing heart and lung disease, especially in children and the elderly. The CAFO provides for a penalty payment of $64,833, includes a certification of compliance with the applicable SIP regulations in Connecticut, and requires Respondent to implement various measures to improve anti-idling compliance at all eighteen of its bus yards in Connecticut. EPA has notified the Connecticut Department of Energy and Environmental Protection of this matter. Neither of the facilities where EPA observed violations are in or near areas of potential environmental justice concern, although four of the locations where Respondent will implement compliance measures (Newtown, Plymouth, Seymour, and Waterbury) are of concern.
