Case summary

On January 5, 2023, a mixed-work settlement, in the form of a CERCLA Administrative Order on Consent between EPA, DOJ, and the Town of Salem, Massachusetts was signed. On April 6, 2023, the mixed-work settlement became effective for the Mansell Field Site, located in the Town of Salem. The AOC is for performance of a removal action at the Site to address soil contaminated with arsenic, chromium and lead. The AOC represents a carefully coordinated 50/50 mixed-work approach, with EPA performing $1.841 million in cleanup work, and the Respondent, City of Salem, performing the rest of the work, valued to be at least that amount, under the terms of the AOC, with EPA oversight. An Action Memorandum selecting a time-critical remedy for the Site was signed on September 8, 2022. The AOC was subject to public comment before becoming effective.
