On August 9, 2023, the United States Magistrate Court signed an ex parte warrant granting EPA access for three years to continue to perform and complete a Remedial Investigation and Feasibility Study (RI/FS) and to commence Remedial Design activities at the Microfab, Inc. (Former) Superfund Site located in Amesbury, Massachusetts under Section 104(e) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980, as amended, 42 U.S.C. 9604(e). This warrant follows two previous warrants approved by the Court, the most recent of which would have expired on August 10, 2023. The abandoned Site is in poor condition. EPA was unable to secure voluntary access to the Site because the former corporate owner of the Site no longer exists and no other company or former corporate officer believed they had authority to grant access to EPA.
