EPA v. AMERICAN WIRE LLC

Case summary

On May 31, 2022, EPA filed a Consent Agreement and Final Order both initiating and resolving an action against American Wire, LLC for alleged violations of the Toxic Substances Control Act (TSCA) and the Rhode Island Lead Poisoning Prevention Regulations (RI LPP Rule). American Wire, LLC (American Wire), a Rhode Island corporation with offices in New Hampshire, provides residential and commercial property renovation services and construction management. American Wire, part of the Brady Sullivan family of properties, is primarily concerned with the renovation and construction management of the former American Wire factory located at 413 Central Avenue in Pawtucket, Rhode Island (Facility) which American Wire owns. Brady Sullivan and American Wire share common ownership. EPA alleged that American Wire failed to ensure that a certified Lead Renovator was designated as the person responsible for oversight of each RRP project and to carry out Lead Renovator responsibilities, post signs clearly defining the work area and warning occupants and other persons not involved in renovation activities to remain outside of the work area, establish and maintain records, and be licensed as a Lead Renovation Firm. American Wire will pay a $25,000 penalty and come into compliance with the RI LPP Rule. American Wire is located in an area of environmental justice concern. Rhode Island has been delegated the authority to implement the Renovation, Repair and Painting Rule and assisted with the inspection. Rhode Island agreed to have EPA prosecute this matter because of EPA's enforcement history with Brady Sullivan.
