Case summary

On June 21, 2022, EPA issued a Notice of Warning (NOW) to pesticide and pesticidal device-producing companies in Massachusetts, including MZ Services, based on the failure to file timely and complete annual production reports. These reports, required under Section 7(c) of the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA), are due by March 1st each year and cover the production, sales and distribution of pesticides and devices for the preceding calendar year. The reports are EPA?s principal source of information on pesticides and devices produced in the U.S. and abroad. The annual production reports allow EPA to have reliable and accurate information about the pesticides imported, sold, or delivered in the U.S., which helps maintain the integrity of the national pesticides program. FIFRA annual reporting is a federal requirement and, while not enforceable by the states under primacy or delegation, each New England state will be notified of any NOW issued to an establishment in their state.
