Case summary

On September 28, 2022, EPA and AFC Cable Systems, Inc. (AFC Cable) settled an administrative penalty case for alleged violations of the Emergency Planning and Community Right-to-Know Act (EPCRA) and EPCRA regulations that occurred at ACF Cable's wire products manufacturing facility in New Bedford, Massachusetts. EPA alleged that AFC Cable failed to timely file EPCRA Section 313 Toxic Release Inventory (TRI) reports for antimony compounds processed at the facility during calendar years 2018 and 2019. AFC Cable filed its missing TRI reports in February 2021. EPA and AFC Cable settled the case with a Consent Agreement and Final Order (CAFO) that both initiated and concluded the action. Under the CAFO, AFC Cable agreed to pay a settlement penalty of $40,000. EPCRA's TRI reporting program is a non-delegated federal program enforced only by EPA. Enforcement of EPCRA?s TRI reporting requirements ensures that communities are not deprived of their right to know about chemicals used or stored within their vicinity that may affect public health or the environment.
