Case summary
On July 19, 2022, EPA filed an expedited settlement agreement (Agreement) entered into with Edgemont Oil, Inc. of Merrimac, Massachusetts addressing violations of the Oil Pollution Prevention regulations, promulgated under Section 311(j) of the Clean Water Act. An EPA Spill Prevention Control and Countermeasure (SPCC) inspection at the company's facility revealed that the facility was not in full compliance with the Oil Pollution Prevention regulations. In particular, the facility failed to have an adequate SPCC plan with an accurate site diagram, implement spill control measures to maintain adequate secondary containment and document and maintain tank inspection records, employee training records and water drainage records. The facility provided a schedule to resolve the violations by August 15, 2022. Pursuant to the Agreement, Edgemont Oil, LLC will pay a $7,700 penalty. While the SPCC program is a direct implementation program, the Region shares copies of all expedited settlements with Massachusetts and the Coast Guard.
