Case summary

On January 28, 2022, EPA Region 1 filed an Expedited Settlement Agreement (Agreement) resolving Clean Water Act violations against the Town of Warren, Massachusetts. EPA determined that the Town failed to comply with its National Pollutant Discharge Elimination System (NPDES) Permit by failing to sample the treatment plant effluent and submit the corresponding Discharge Monitoring Reports (DMRs) from April through August 2021, in violation of Section 301(a) of the Clean Water Act, 33 U.S.C. 1311(a). The Town also violated its pH limits during May and June 2021. Under the NPDES Wastewater Expedited Settlement Agreement Pilot Program, the Town agreed to a $13,219 penalty. EPA implements the NPDES program in Massachusetts. EPA consulted with the Massachusetts Department of Environmental Protection on this matter.
