Case summary
On January 4, 2022, EPA-Region 1 filed an expedited settlement agreement entered into with Turner, Inc. of Lynn, Massachusetts, addressing violations of the Oil Pollution Prevention regulations, promulgated under Section 311(j) of the Clean Water Act. On October 23, 2021, EPA conducted a Spill Prevention Control and Countermeasure (SPCC) inspection at Turner Inc.'s facility and observed that the facility did not have an SPCC plan despite having more than 1,320-gallons of oil storage capacity in aboveground containers greater than 55-gallons in capacity (total capacity of approximately 5,770 gallons). Pursuant to the agreement, Turner, Inc. will pay a $12,016 penalty and has certified that it has corrected its violations. According to EPA's EJ Screen application, the Facility is located in or near an area in which several Primary EJ Indexes are at or above the 80th percentile nationally. The SPCC Program is a direct implementation program; however, the Region shares copies of all expedited settlements with the state and Coast Guard.
