EPA v. CONSOLIDATED COMMUNICATIONS
Case summary
On August 9, 2022, EPA issued a Clean Air Act administrative order on consent to Consolidated Communications of Northern New England Company, LLC (Consolidated Communications) to require it to comply with the National Emission Standards for Hazardous Air Pollutants for Stationary Reciprocating Internal Combustion Engines by ceasing to participate in an active Demand Capacity Resource program at three of its facilities. Consolidated Communications operates three generators located in Sanford, ME, and Bath, VT, and Brattleboro, VT. The generators are not retrofitted with control devices. Generators such as these that participate in active Demand Capacity Resource programs are not considered emergency generators and are required to be retrofitted with control devices. By withdrawing from the Program, the generators are able to be reclassified as emergency generators and not require the retrofits to comply with the regulations. There are no environmental justice implications associated with this action.
