Case summary

On May 3, 2022, EPA filed a Consent Agreement and Final Order (CAFO) both initiating and resolving alleged violations of Section 112(r) of the Clean Air Act (CAA) and risk management planning regulations against Crystal Ice Co., Inc., an ice-making facility located in New Bedford, Massachusetts (Facility). EPA inspected the Facility in 2018 after a release of ammonia occurred at the Facility. In the CAFO, EPA alleged that Crystal Ice violated risk management planning requirements including failure to comply with requirements to compile written process safety information and comply with recognized and generally accepted good engineering practices, failure to fully comply with process hazard analysis requirements, and failure to adequately conduct and document training. Crystal Ice has agreed to pay a penalty of $170,000 and will come into compliance with risk management planning requirements. Crystal Ice is located in an area of environmental justice concern. Clean Air Act 112(r) is a direct implementation program. However, EPA will share a copy of the CAFO with the Commonwealth of Massachusetts.
