Case summary
On June 23, 2022, a U.S. Magistrate Judge signed an ex parte administrative warrant granting EPA access to the E.J. Abbott Memorial Trust Site in Wilton, New Hampshire. This warrant is necessary because the Agency has been unable to locate a person authorized to grant access to the Site. The warrant provides EPA with access to perform a preliminary assessment and site investigation under the Superfund removal program to investigate the potential release of sodium cyanide at the Site. EPA has been working closely with the State of New Hampshire and the Town of Wilton on this planned site investigation. On April 13, 2022, Region 1 referred a request to the Department of Justice (DOJ) for the issuance of an ex parte administrative warrant at the E.J. Abbott Memorial Site in Wilton, New Hampshire. This warrant is necessary because, despite significant efforts, EPA has been unable to locate a person who is able to grant access to the Site. EPA requests access to perform a preliminary assessment and site investigation under the removal program to investigate the potential release of sodium cyanide at the Site.
