Case summary

On August 10, 2021, EPA filed a Consent Agreement and Final Order (CAFO) resolving four alleged violations of the Toxic Substances Control Act (TSCA), and the federal regulations promulgated thereunder, collectively referred to as the Renovation, Repair, and Painting Rule (RRP Rule) against J. Corrigan, LLC (J. Corrigan). The alleged violations arose out of the renovation of a single-family home built in 1950 located in Windsor Locks, Connecticut. This location falls within a focus area of EPA Region 1's Lead Geographic Initiative. EPA alleged that J. Corrigan failed to obtain firm certification, provide the homeowner with a pre-renovation education pamphlet, ensure compliance with work standards (specifically, contain waste from renovation activities), and comply with record-keeping requirements (specifically, make available records in response to EPA's Information Request Letter). In the settlement agreement, J. Corrigan agreed to pay a penalty of $1,253, obtain firm certification, and comply with all applicable RRP rules moving forward. According to EPA's EJSCREEN, the facility is not an area in which the environmental justice indices are at or above the 80th percentile. This settlement is expected to encourage compliance in the regulated community with the RRP Rule. The State of Connecticut has been notified of this action.
