On April 16, 2021, EPA filed a consent agreement and final order (CAFO) both initiating and resolving claims for civil penalties against Scott Pires d/b/a The Valley's View (Respondent). Respondent failed to comply with lead-based paint renovation requirements during renovation work at a residential property in Wells River, Vermont in violation of the Toxic Substances Control Act and the Renovation, Repair and Painting Rule (RRP Rule), 40 C.F.R. Part 745, Subpart E. Lead paint that is compromised can pose serious health hazards. Pursuant to the CAFO, Respondent will pay a penalty of $600 calculated in accordance with EPA's Graduated Penalty Approach Policy and will operate his business in compliance with the RRP Rule. EPA investigated the case in coordination with the Vermont Department of Health's Lead Program.
