On June 24, 2021, EPA Region 1 filed a combined complaint and consent agreement as an expedited settlement to simultaneously commence and conclude enforcement actions against Allen Engineering, Inc. of Rutland, Vermont (Respondent) for alleged violations of Section 7(c) of the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA), 7 U.S.C. 136e. The agreement alleges that Respondent failed to file or timely file annual pesticide production report(s) in connection with each registered establishment. FIFRA Section 7 reporting requirements are enforced federally and not delegated to the states.
