On May 10, 2021, Region 1 filed an Expedited Settlement Agreement with the Regional Hearing Clerk resolving violations of Section 311(b)(3) of the Clean Water Act with Atlantis Real Estate, LLC (Atlantis). Atlantis owns and operates a gas station in Pittsfield, Massachusetts. On December 31, 2020, approximately seven to eight gallons of diesel fuel spilled to the ground when a service station employee left a truck unattended during fueling, and the nozzle disengaged from the fuel tank. The spilled fuel entered a drainage swale and flowed into the East Branch of the Housatonic River. The company has agreed to a $4,300 penalty. The Region worked in coordination with Massachusetts in this matter.
