Case summary
On March 18, 2021, Region 1 issued a Clean Water Act Administrative Compliance Order (Order) to the Town of Montague, Massachusetts (Town) for its non-compliance with the conditions of its National Pollutant Discharge Elimination System (NPDES) permit authorizing discharges from its publicly-owned treatment works. Permit compliance areas addressed by the Order include numeric effluent limit exceedances and combined sewer overflow nine minimum controls. The Order requires the Town to prepare plans to come into compliance and submit the plans to EPA and the Massachusetts Department of Environmental Protection (MA DEP). The NPDES program has not been delegated to Massachusetts, but MA DEP supports issuance of this Order. The Order is part of EPA's National Compliance Initiative for Reducing Significant Non-Compliance with NPDES Permits.
