Case summary

On February 11, 2021, EPA entered into a settlement agreement with Anthony Troiano & Sons, Inc (Troiano) under which the company will pay a $66,000 fine to settle claims that it violated the federal Oil Pollution Prevention regulations, promulgated under Clean Water Act 311. Among other things, EPA found that Troiano's Spill Prevention Control and Countermeasure plan was insufficient and that the facility did not have adequate secondary containment for its oil storage tank, loading rack, and off-loading area. Additionally, because the facility has oil storage capacity greater than a million gallons, failed to have sufficient secondary containment, and is located such that an oil discharge could cause injury to fish and wildlife and sensitive environments, EPA found that Troiano company had failed to prepare and implement a Facilities Response Plan. EPA previously issued an administrative order to Troiano to come into full compliance with the regulatory requirements.
