Case summary

On August 15, 2018, the United States District Court for the District of Massachusetts signed an Administrative Inspection Warrant pursuant to CERCLA 104(e), authorizing EPA's access for up to three years (until August 15, 2021) to a 13.8-acre parcel of property located at 104-106 Haverhill Road (the Property) within the Microfab, Inc. (Former) Superfund Site in Amesbury, Massachusetts (the Site). The Property's owner of record is Microfab, Inc. (Microfab). However, Microfab declared bankruptcy in the 1980s and has been dissolved; the Property has been abandoned, inactive, and unoccupied for many years; and EPA was unable to locate anyone willing or able to grant access to the Property. EPA has been seeking access to the Property to investigate the nature and extent of contamination, specifically, to perform an RI/FS and a removal site evaluation. On August 10, 2021, the same Court signed an Administrative Inspection Warrant pursuant to CERCLA 104(e), authorizing EPA to have continued access to the Property to continue to perform and complete the RI/FS at the Property for an additional two years until August 10, 2023.
