Case summary
On January 12, 2021, the Region filed an administrative Consent Agreement and Final Order resolving its claims against Cashman Dredging & Marine Contracting Co., LLC of Quincy, Massachusetts for alleged violations of the Marine Protection, Research, and Sanctuaries Act (Ocean Dumping Act) occurring during the disposal of material dredged from the construction of a confined aquatic disposal cell in New Bedford Harbor. EPA alleged that in the Summer 2020, Cashman dumped dredged material at a location outside the authorized Rhode Island Sound Disposal Site (RISDS) on one occasion, and in the wrong locations within RISDS on three other occasions. The noncompliance was verified both by the electronic monitoring devices on board the disposal vessels, as well as in Cashman's responses to the US Army Corps of Engineers, with which EPA had closely coordinated. Under the terms of the settlement, the company agrees to pay a $185,000 penalty.
