Case summary

On January 7, 2020, Region 1 filed a consent agreement and final order (CAFO) resolving TSCA violations at the Clean Harbors of Connecticut, Inc. facility located in Bristol, Connecticut. The CAFO alleges that the Respondent violated non-disposal and disposal regulations governing manifesting and disposal of PCBs and PCB remediation waste including failure to properly manifest waste and disposal of PCB remediation waste in a non-TSCA facility located in Region 2. Pursuant to its RCRA permit, the Respondent reported the non-compliance in June 2019 as soon as it became aware of the incidents. The company has agreed to pay a $58,338 penalty to resolve this matter and certifies that it is now operating in compliance with TSCA. The Region has coordinated with the State of Connecticut and Region 2 in this action. The State is not authorized to enforce the PCB regulations but supports the action. Region 2 deferred to Region 1 for the enforcement action.
