Case summary

On September 16, 2020, Region 1 and the Bourdon Forge Co., Inc. (Bourdon Forge) settled an administrative penalty case for alleged violations of the Emergency Planning and Community Right to-Know Act (EPCRA) and EPCRA regulations that occurred at Bourdon Forge's metal hardware manufacturing facility in Middletown, Connecticut. EPA alleged that Bourdon Forge failed to timely file EPCRA Section 313 Toxic Release Inventory (TRI) reports for chromium, copper and nickel processed at the Bourdon Forge facility during calendar year 2018. Bourdon Forge filed its missing TRI reports in 2020. EPA and Bourdon Forge settled the case with a Consent Agreement and Final Order (CAFO) that both initiated and concluded the action. Under the CAFO, Bourdon Forge agreed to pay a settlement penalty of $54,705.
