Case summary
On June 29, 2020, EPA-Region 1issued an administrative order under Section 309(a) of the CWA to S.E. Wright, Inc., a developer operating the Spruce Farms site under construction in Wilmington, MA. On July 12, 2019, EPA conducted an inspection at Spruce Farms. Through that inspection and a follow up information request, EPA determined that S.E. Wright, Inc. failed to keep a current copy of its Stormwater Pollution Prevention Plan (SWPPP) at the site, in violation of Part 7.3 of the National Pollutant Discharge Elimination System (NPDES) General Permit for Discharges from Construction Activities (Permit), and failed to document required inspections of erosion controls, in violation of Part 4.7 of the Permit. The Order, requires S.E. Wright to submit copies of SWPPPs for all sites it is or has been operating in 2020, and requires the company to provide inspection reports moving forward for the next nine months.
