08/17/21 - On March 18, 2021, the Environmental Appeals Board issued an Order vacating its earlier order for sua sponte review, issued Feb. 9, 2021. Under the March 18 Order Vacating Order Electing to Exercise Sua Sponte Review, within 45 days of service of the Order to Vacate, the Dec. 29, 2020 Default Order from the Regional Judicial Officer will become a final order. Respondent's payment of the $1,456 penalty will come due within thirty days of the final order, or by June 1, 2021. In the event of nonpayment, debt will be handled as a collections matter. On September 30, 2019, Region 1 filed an administrative civil complaint for penalties against a Scarborough, Maine residential renovation firm for violating regulations related to lead-based paint, specifically, the TSCA Renovation, Repair and Painting (RRP) Rule's certification/ training, disclosure and work practice requirements. The complaint alleges several violations by Build-It Bros. stemming from a renovation at a multi-unit residential property in Portland, Maine. EPA first learned of the violations from the Maine DEP following an anonymous tip DEP received regarding exterior work conditions at the site.
