Case summary
On June 26, 2019, Region 1 filed a Clean Water Act Expedited Settlement Agreement with Russo Bros. Inc., the site contractor at a property in Bellingham, Massachusetts that is being developed into small residential condominiums. Based on a site inspection, Region 1 determined that Russo Bros. Inc. had failed to meet sediment control requirements at the site, in violation of the National Pollutant Discharge Elimination System (NPDES) General Permit for Discharges from Construction Activities. Russo Bros. Inc. addressed its noncompliance shortly following the Region 1 inspection. The company will pay a penalty of $1,800. While EPA implements the NPDES program in Massachusetts, the case team did send notification to the Massachusetts Department of Environmental Protection of this matter.
