Case summary

On February 28, 2019, EPA issued an Administrative Order (Order) against the Town of Hopedale, MA regarding the Town's Municipal Separate Storm Sewer System (MS4). The Order require the Town to submit a Notice of Intent (NOI) to be covered under the 2016 Massachusetts Small Municipal Separate Storm Sewer General Permit or an application for an individual NPDES permit by April 1, 2019. The Order does not include a penalty. The Town's NOI submittal weas due October 1, 2018. As of the date of the Order, the Town has not submitted the required NOI or an individual NPDES permit application. Although EPA has primacy for the NPDES program in Massachusetts, MassDEP supports EPA's action in this matter.
