Case summary
On December 6, 2018, Region 1 entered into an expedited settlement agreement with John S. Lane & Son, Inc.-Westfield Quarry in Westfield, Massachusetts, addressing violations of the Oil Pollution Prevention regulations at 40 C.F.R. Part 112, promulgated under Section 311(j) of the Clean Water Act. An EPA Spill Prevention Control and Countermeasure (SPCC) inspection at the facility revealed that it did not have a fully implemented SPCC plan. Specifically, the SPCC plan did not include certification by a professional engineer, failed to include an adequate facility diagram, and failed to contain inspection records, as well as other deficiencies. Pursuant to the agreement, John S. Lane will pay a $3,400 penalty. The SPCC Program is a direct implementation program, but EPA coordinated with the Massachusetts Department of Environmental Protection in this action and they were supportive of EPA?s penalty for the SPCC violations.
